Will family file wrongful death suit when at-fault driver found?

When a family loses a loved one in an accident due to the negligence of one or more other parties, surviving family members have the right to file a lawsuit seeking restitution for financial damages incurred. Under Connecticut law, certain damages may be sought in a wrongful death claim such as last medical expenses, loss of the income of the decedent and the costs of the funeral and burial. However, filing such claims typically requires knowing what party or parties are thought to be responsible, which might not be available for some time in hit-and-run crashes such as one that took place recently.

Just two days before Christmas, a 55-year-old man was riding his bicycle in Shelton. A vehicle struck him along Bridgeport Avenue. The driver did not remain at the scene despite the fact that the bicyclist was seriously injured. When emergency personnel arrived, they rushed the accident victim to a hospital in the area.

That day, his condition was listed as critical. Sadly, his injuries were too severe, and he succumbed to them on Christmas Eve. Witnesses provided statements to police, and as part of the ongoing investigation, an accident reconstruction team was dispatched to the scene. Anyone who witnessed the crash who has not yet spoken to police is urged to contact the Shelton Police Department.

Not only do officials want to know who is responsible, but the family also deserves to know. Furthermore, if the victim's family determines that filing a wrongful death claim is a course of action that they wish to pursue, they will need to know against whom to file the lawsuit. If that individual's negligence can be established to a Connecticut court's satisfaction, the family may be awarded a judgment for monetary damages.
