Premises liability claims in slip and fall accidents

When a Connecticut resident is invited onto someone else's property, they are entitled to expect that it is safe and free of hazards. Unfortunately, not all property owners are diligent when it comes to keeping their property safe. Slip and fall accidents can cause devastating injuries, and a premises liability claim might be appropriate in the aftermath of such an accident.

Property owners might attempt to claim that they were unaware of the hazard that caused the fall, but that does not mean that they are not liable. Their duty to keep an eye out for anything might cause injury to guests. If they are made aware of a hazard, it should be dealt with immediately in order to limit the potential for accidents. Identifying areas where accidents could occur and taking appropriate precautions is also their responsibility. For instance, removing snow and ice should be done as much as possible in order to keep walkways clear, and lighting should be added to areas that are particularly dark.

It should be noted, however, that Connecticut courts could also take into consideration an individual's actions on the premises. For example, if a person is texting and not paying attention to where he or she is walking prior to the fall, the court could consider the person partially responsible for the injuries suffered. As long as the court does not rule that the victim is more than 50 percent at fault, an award of damages can be made.

A property owner's premises liability can come from many sources. If one fails to maintain the property to limit slip and fall accidents, the owner could be held liable if someone is injured. It is also up to the victim to be aware of his or her surroundings and not to enter into areas that might be unsafe. Regardless of the circumstances, anyone who suffers injuries on someone else's property has every right to consult with an attorney regarding whether filing a claim is appropriate.
