Investigations into motorcycle accidents can take a long time

Law enforcement officials here in Connecticut and around the country are not always able to conclude an investigation in the weeks or months that follow a crash. In some cases, families have to wait a significant amount of time before having the answers they seek regarding the death of a loved one. This could be true for car, truck or motorcycle accidents.

For instance, in Sept. 2015, a 50-year-old woman died due to injuries she suffered in an car vs. motorcycle accident. Her motorcycle collided with a car driven by a 21-year-old man. Officials conducted an investigation that lasted nearly a year.

Only recently did the inquiry into the crash conclude when the car driver, who lives in Massachusetts, surrendered to the Connecticut State Police. He faces charges of failing to obey a stop sign, negligent vehicular homicide and possession of marijuana. At his arraignment, he was allowed to post bond and was scheduled to return to court on Sept. 19.

The family of the victim might feel as though they now have some answers regarding the death of their loved one. Furthermore, the details and evidence derived from the investigation could help surviving family members if they exercise their right to file a wrongful death claim against the driver. Even if prosecutors do not secure a conviction on the charges relating to the crash, it is possible to be successful in civil court where the burden of proof is not as stringent.

As is the case in other deadly motorcycle accidents, the evidence needs to establish that the fatal injuries suffered were caused by the negligence of another. Successfully proving this to the court could result in the consideration of an award of damages. Financial restitution will not bring back a loved one, but it could help with the unexpected financial burdens incurred as a result.
