Seeking damages for intangible loss

Recovering from a car accident may seem like a straightforward process, but it can be deceptively complex and lengthy. While you might be able to easily measure how long it takes you to recover from many forms of physical injury, it is often the less visible forms of injury that take the longest to heal and are some of the most painful.

The law recognizes this peculiarity, which serves as much of the basis for seeking damages for pain and suffering. The very concept of seeking compensation for pain and suffering sometimes bears a bad rap in the public eye, which is understandable until it happens to you.

Once you've had to live through the anguish of recovering from a serious accident, seeking damages for pain and suffering suddenly make a great deal of sense.

After an accident, there are many ways that you may suffer on your way to recovery — if you are able to fully recover at all. Some injuries are practically costly, while simultaneously carrying a heavy burden psychologically. Take, for instance, the athlete who breaks a leg in a car accident. While there are fairly predictable timetables for how long one might expect him or her to need in order to get back on the field, the accident may take away a great deal of the individual's confidence.

Similarly, an actor who experiences some form of disfigurement may find it difficult to find work while also shouldering an existential burden brought on by one's changed appearance — especially if appearance is key to his or her identity and livelihood.

These are some, but not all, of the factors that may contribute to seeking compensation for pain and suffering after an accident. If you have been involved in an accident and have suffered as a result, it is crucial to get the help of a qualified, empathetic attorney who understands how to respect your experience and place a fair value on the suffering you've endured. With proper legal guidance, you can protect your rights and pursue fair compensation for what you've lost and suffered.
