Premises liability is not always a simple matter

Premises liabilities suits often involve people injured in areas where the responsible party is not entirely clear. If you have been injured in by poorly maintained property, it is important to get the help you need to find the appropriate responsible party so you can pursue justice for your injuries. However, that is sometimes easier said than done.

Let's assume that you are walking on a public sidewalk near a construction site, and are injured in a fall after tripping on something related to the construction. This might be debris from the site, for instance. In a case like this, you may be able to hold the construction company liable for your injury, if you can prove that the construction site was responsible for the debris that caused your fall.

However, it may not actually be the construction company at fault, ultimately. Perhaps the debris was not from the company at all, but simply seemed that way. Then, it becomes a matter of determining who is responsible for the safe upkeep of the sidewalk. Typically, this is the city or municipality related to the sidewalk. Furthermore, if your injury was caused by a poorly maintained sidewalk, the city or municipality charged with maintaining the sidewalk may be held liable.

There is no one-size-fits all solution when it comes to premises liability suits, and each must be evaluated on its own merits. If you have been injured in a slip-and-fall accident or some other type of premises liability accident, you deserve to have your circumstances examined by a qualified attorney who understands the nuances of the law.
