CASE: Motor Vehicle, Trucking Company

Situation:
A 54-year-old male laborer with a long history of back injuries was rear ended, aggravating previous back injuries & conditions, requiring surgery. He was slow to heal because of obesity and smoking.

Outcome:
Dressler Strickland pursued a difficult legal theory of recklessness against the defendant, a trucking company. CASE: Premesis Liability

Situation:
A 62-year-old man fell while going up the stairs in a housing complex. Witnesses say he was helping others carry a mattress up the stairs.  Hospital emergency room found alcohol and cocaine in his system. The client suffered traumatic brain injury and was placed in a nursing home. The owner of a housing complex and its insurance company refused to offer any settlement for four years.

Outcome:
Through intensive investigation, pressing unusual legal claims and by being obviously ready, willing and able to proceed to trial, Dressler Strickland obtained a $450,000 settlement for the client, in spite of negative eyewitness claims and positive blood tests for alcohol and drugs.

CASE: Defective Product

Situation:
A 45-year-old construction worker was injured when struck in his face by metal from the exploding tip of a nail gun. The nail gun manufacturer refused to pay any money because it claimed it had never heard of any other similar incidents with its products. 

Outcome:
Dressler Strickland and their experts came up with a winning theory: the product was defective because it was made with high carbon steel and the accident would not have happened if it was made from a chrome-molybdenum steel.  The case settled prior to trial for an undisclosed amount.
